General Information

Welcome to ScoobyDoc! ScoobyDoc is an online platform that allows licensed veterinarians and veterinary technicians ("Vets") to provide virtual veterinary care and advice to pet owners ("Clients") for their pets and service animals (collectively referred to as "Pets").

For the purposes of these Terms of Use, "virtual veterinary care" refers to the delivery of veterinary advice and guidance (which may include telehealth, teletriage, telemedicine, and online consultations) using digital communication technologies where the Vet and the Pet are not in the same physical location.

USE OF THIS SERVICE IS NOT FOR EMERGENCIES. IF YOUR PET IS EXPERIENCING A MEDICAL EMERGENCY, PLEASE SEEK IMMEDIATE CARE AT THE NEAREST OPEN VETERINARY CLINIC OR HOSPITAL.

These Terms of Use ("Terms") are a binding contract between all users of our platform, including both Vets and Clients (each a "user," "you," or "your"), and ScoobyDoc, Inc. ("ScoobyDoc," "we," "us," or "our") regarding the use of our website, mobile application, or any other platform where these Terms are posted (collectively, the "Site") and the services provided through the Site (the "Services").

By using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any portion of these Terms, you must discontinue use of the Services immediately.

To use our Services, you must be at least the age of majority in your jurisdiction and have the capacity to enter into a legally binding contract with ScoobyDoc. If you are using these Services on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.

Part A – Terms Applicable to All Users

1. Our Services

ScoobyDoc is an online marketplace that facilitates virtual veterinary care between Vets and Clients. Vets may provide professional advice, guidance, and, where legally permitted, prescribe medication. However, ScoobyDoc does not itself provide veterinary care, pharmaceutical services, or professional services.

ScoobyDoc is a technology provider that enables access to independent veterinary professionals. The Vets available through the Site are not employees, agents, or representatives of ScoobyDoc, and ScoobyDoc does not credential, oversee, or assume liability for their services.

Users understand that ScoobyDoc is not a party to any agreements or transactions between Clients and Vets, even when the platform provides tools for booking, communication, and payments. All virtual veterinary care, including the appropriateness of advice, accuracy of diagnoses, and prescription of medication, is solely the responsibility of the individual Vet.

2. Account & Identity Verification

To use certain features of the Services, you must create an account ("Account"). You agree to provide accurate and complete information and to update your information as needed. You are responsible for maintaining the confidentiality of your login credentials and are fully responsible for all activities under your Account.

ScoobyDoc reserves the right to suspend or terminate any Account suspected of unauthorized or fraudulent activity.

3. Intellectual Property

All content on the Site, including text, software, trademarks, and images, is owned or licensed by ScoobyDoc. You are granted a limited, non-transferable, non-exclusive right to use the Services for their intended purpose. Unauthorized use, reproduction, or distribution of any ScoobyDoc materials is prohibited.

4. No Unlawful or Prohibited Use

By using the Services, you agree that you will not:

  • Engage in fraudulent, abusive, or illegal activities.
  • Attempt to disrupt or interfere with the Site.
  • Use the Services for spam or unauthorized commercial purposes.

5. Limitations of Liability & Disclaimers

ScoobyDoc provides the Services on an "as is" and "as available" basis, with no warranties regarding accuracy, completeness, or availability. We do not guarantee that veterinary consultations will result in any specific outcome.

To the maximum extent permitted by law, ScoobyDoc and its affiliates will not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Services. If you are dissatisfied with the Services, your sole remedy is to discontinue use.

6. Indemnity & Release

You agree to indemnify and hold harmless ScoobyDoc and its officers, employees, and affiliates from any claims, damages, or losses resulting from your use of the Services, your reliance on any veterinary advice received, or your violation of these Terms.

7. Disputes & Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration, except where prohibited by law. Arbitration shall take place in the jurisdiction where ScoobyDoc is headquartered. By agreeing to arbitration, you waive any right to participate in a class action lawsuit.

8. Modifications & Termination

ScoobyDoc may modify these Terms at any time. Updated Terms will be posted on the Site with the "Last Updated" date. Continued use of the Services after modifications constitutes acceptance of the new Terms. We may also terminate or suspend the Services at our discretion.

Part B – Additional Terms for Clients

1. Consultation Fees & Payments

Clients are responsible for all fees associated with virtual veterinary consultations. Payments are processed through a third-party provider, and ScoobyDoc is not responsible for payment disputes.

2. Subscription Plans

ScoobyDoc may offer subscription plans for veterinary consultations. These plans are subject to specific terms outlined at the time of subscription.

3. Refund Policy

Consultation fees are non-refundable, except in cases where:

  • A Vet does not attend a scheduled consultation.
  • The consultation ends in less than three minutes due to a technical issue.

Refunds are processed at ScoobyDoc’s discretion. Subscription fees are subject to the terms outlined in the subscription plan.

Part C – Additional Terms for Vets

1. Compliance with Laws

Vets using ScoobyDoc are responsible for ensuring compliance with all applicable laws and regulations regarding veterinary telehealth, prescriptions, and the establishment of a veterinary-client-patient relationship (VCPR).

2. Professional Liability Insurance

Vets must maintain appropriate professional liability insurance and provide proof upon request.

3. Listing & Content Responsibility

Vets are responsible for the accuracy of their listings, pricing, and practice information. ScoobyDoc reserves the right to modify or remove listings that violate these Terms.

4. Payment Processing

Payments for consultations are processed through a third-party provider. Vets must not accept direct payments outside the ScoobyDoc platform.
